Transparency in the Chinese Courts on IP: My new article on “The Case of the Missing Cases”

My article, “China’s Judiciary: The Case of the Missing Cases” has been published today (July 18, 2023), by the Hinrich Foundation.  It is available here.

The article seeks to better integrate general Chinese law scholarship on China’s judicial database and scholarship on intellectual property to demonstrate the continuing utility of using China’s judicial databases while at the same time maintaining a critical view of the limitations of that database.  I also provide some estimates on the extent to which cases may be missing, discuss possible alternative sources of information and highlight the importance of those missing cases to the foreign business community.
